Who we are
This website is run by Farlend, a digital commerce studio.
Project agreements
Every project starts with a written proposal setting out its scope, price, timeline and payment terms. Once you accept it, that agreement governs the work. Where it differs from these terms, the project agreement wins.
Quotes and changes
Quotes are valid for 30 days from the date they are sent. Scope and price are fixed once agreed. If something needs to change during a project, we quote the change and wait for your approval before doing it.
Payment
Invoices are payable within the period set out in your project agreement. We may pause work while an invoice is overdue, and will tell you before we do.
Ownership
The code, designs and other work we create for you become yours once you have paid for them in full. We may reuse general tools, techniques and know-how that are not specific to your project.
The content, design and branding of this website belong to Farlend and may not be copied without our permission.
Platforms and third-party services
Most projects run on platforms and services we do not control, such as Shopify, WooCommerce, hosting providers and apps. Your use of them is subject to their own terms, and we are not responsible for their outages, price changes or decisions.
AI features
Where a project includes AI features, we build and connect them: your data going in, the request to the AI model, and the result coming back. The models themselves are run by third parties, and we cannot guarantee what they produce. AI output can be wrong, incomplete or out of date.
Anything written or suggested by AI should be checked by your team before it goes live or is acted on. Decisions made from AI output remain your own, and we are not responsible for the results of those decisions.
Information on this website
What we write on this website is general information about our services. It is not legal, tax or financial advice, and you should take your own advice before relying on it for a business decision.
Using this website
Please do not use this website for anything unlawful, or try to access parts of it, or the systems behind it, that are not meant to be public. Links to other websites are provided for convenience; we are not responsible for their content.
Personal information
We handle personal information in line with South Africa's Protection of Personal Information Act (POPIA). If you are in the UK or the European Union, the UK GDPR or the EU GDPR may also apply to how we handle your information. Our privacy policy explains what we collect and what you can ask us to do with it.
Liability
Our liability for any project is limited to the amount you have paid for that project, unless your project agreement says otherwise. We are not liable for indirect losses such as lost profit or lost data. Nothing in these terms limits liability that cannot be limited by law.
Changes and governing law
We may update these terms; the date at the top of this page shows when they last changed. Work already agreed stays under the terms that applied when it was agreed.
These terms are governed by the laws of South Africa, where Farlend is based, and disputes will be dealt with by the South African courts.
